TERMS AND CONDITIONS OF POINTS CLUB

These terms and conditions (the "T&C") govern the Grupo Tierra Gaucha Loyalty Club for frequent guests of Grupo Tierra Gaucha hotels (hereinafter referred to as "Grupo Tierra Gaucha Points Club" or the "Club"), operated by Grupo Tierra Gaucha, owned by FEJU SRL and CONCEPTO PATAGONICO SRL, domiciled at Gallardo 306 Dpto 18 y moreno 136, San Carlos de Bariloche, Rio Negro, Argentina.

By becoming a member of the Club, you agree that you have read, understood and accepted the (a) T&C, (b) the terms of use of the website, (c) the terms of use of the website, (d) the terms of use of the website, and (e) the terms of use of the website. www.grupotierragaucha.com.ar and sites belonging to the chain and (c) the Privacy Policy of the website.

These T&C may be replaced or amended whenever Grupo Tierra Gaucha so requires, either in whole or in part, without the need to obtain prior express consent. This is because at any time you may cease to be a member of the Club and, consequently, your continued participation in the Club is understood as acceptance of any modification of the T&Cs. It is your responsibility as a member of the Grupo Tierra Gaucha Points Club to keep yourself well informed of the T&C and any modification thereof, so we suggest you consult them regularly. Grupo Tierra Gaucha may eliminate the Club without prior notice to Club members and without granting them the right to compensation for benefits not enjoyed.

Description of the Tierra Gaucha Group Loyalty Club. Participating hotels.

1.1. The Club is a rewards program for frequent guests of Grupo Tierra Gaucha hotels, and any other hotel that has joined it as established in section 3 of this document (hereinafter, the "Benefits").

1.2. The hotels of Grupo Tierra Gaucha (hereinafter, the "Participating Hotels") that participate in the Club are listed on the website.

The Benefits granted can only be used at Participating Hotels.

Both the incorporation of other hotels to the Club and the elimination of hotels from the list of Participating Hotels will be communicated as established in these T&C and you will only be able to enjoy the Benefits (i) in those accommodations that are Participating Hotels at the time of the use of the Benefit; (ii) of your incorporation as a member of the Club. Therefore, you may not claim any benefit for nights contracted prior to the same, nor enjoy Benefits in hotels removed from the list of Participating Hotels after such removal, even if the reservation in the hotel that used to be a Participating Hotel had been made prior to its removal.

Tierra Gaucha Group Points Club Membership. Requirements and registration procedure.

2.1. To become a member of the Club, the following conditions must be met:

(a) Be a natural person, resident in a country that legally permits participation in this Club. No legal entity may join the Club.

(b) Be at least 18 years of age.

(c) Be legally able to accept these T&Cs.

(d) Complete the Club registration application through the Web Site / Central Reservations Office or at any participating hotel of Grupo Tierra Gaucha.

(e) Provide all the data required by the registration form and have a valid e-mail address, where all notifications required by the Club will be made. Inaccuracy or misrepresentation of the data provided, or the absence of any of them, will invalidate the registration application. Any communication sent to a Club member shall be deemed to have been received two working days after having been sent to the e-mail address duly provided. It shall be the obligation of each member of the Tierra Gaucha Group Club to keep his/her personal data updated and to constantly review the e-mail address provided.

(f) Not have been previously removed as a member of the Club for any of the reasons provided for in these terms.

2.2. Registration as a member of the Club is free of charge. There is no obligation to purchase.

2.3. Membership status:

Club member status shall be retained until the member is removed from the Club for any of the reasons provided for in these T&Cs. No Club member shall be removed from the Club for failure to purchase nights in any period. Enrollment in the Club and maintenance of membership status does not require the purchase of nights at Participating Hotels.

2.4. Reservations where points are used for payment must be made by the member.

2.5. Registration as a member of the Club will be effective automatically. The identification as a member of the Club shall be through the registered e-mail address, First Name and Last Name. The benefits are registered from the date on which the membership is created. Subsequent registration is not possible for stays made prior to membership.

2.6. In the event that, after registration, Grupo Tierra Gaucha confirms with respect to the Club member the non-compliance of any of the requirements to be considered as such, it will be withdrawn, informing of such circumstance and the reasons for the same.

2.7. Any change in the information provided by a member at the time of registration in the Club must be duly modified in the profile of the Club member's user account. Grupo Tierra Gaucha will not be responsible for any modification of the data that has not been duly informed.

2.8. Grupo Tierra Gaucha reserves the right to remove a member from the Club without prior notice and immediately, which will automatically generate the loss of all accumulated points and their status in any of the categories. Grupo Tierra Gaucha may exercise this right in the event that the Club member:

(i) shows inappropriate behavior, or commits acts that may be penalized, or that are immoral, unethical or discriminatory in any of the Participating Hotels or in any other hotel operated and/or managed by Grupo Tierra Gaucha.

(ii) omit to pay any invoice, for any concept, to the Tierra Gaucha Group, to any of the Participating Hotels or to any other hotel operated and/or managed by the Tierra Gaucha Group.

(iii) breaches the Website's terms of use and/or the Website's privacy policy, and/or the T&Cs;

(iv) improperly uses or obtains the Club-related Benefits

(v) any other circumstances not specified above.

2.9. Likewise, any member of the Club may request the cancellation of its membership by sending an email to club@grupotierragaucha.com.ar, with the subject CANCELLATION OF MEMBERSHIP. Once this email is received and processed, all benefits will be automatically cancelled.

2.10 Points, as provided herein, shall be awarded for stays booked and paid for by the Member, up to 4 rooms per reservation. Reservations of +4 rooms will be considered a "Group Reservation" and no points will be awarded.

2.11 Points can only be awarded to one member per reserve.

2.12 To redeem Points for a reservation made on the website, the chain's sites, or the reservation center, log in to your account at https://grupotierragaucha.com.ar/clubdepuntos/ You can pay for a reservation in part or in full using points, you can redeem all your points or only some of them in a reservation.

2.13 You can use points for partial or full payment of invoices also during a hotel stay. This is only possible for bookings made through valid booking channels (as set out in section 3.1 of this document). This means that you cannot pay for hotel purchases using POINTS if the booking of the stay has been made through third-party channels (such as Booking, Expedia, Despegar or others).

2.14 If the cancellation occurred in a reservation partially paid with points, they will be returned to the holder. Cancellations must be made through the Central Reservation Office by phone +54 9 294 434 1212 or by e-mail to centralreservas@grupotierragaucha.com.ar

2.15 Any changes to reservations for which full or partial payment has been made with points must be made by mail to the following address club@grupotierragaucha.com.ar  Such changes cannot be made through the website.

Benefits. Use of the same.

3.1. The benefits of the Club are as follows:

a) Exclusive offers and promotions: Club members will receive offers and promotions to the e-mail address indicated at the time of registration. Only the Club member will be able to make effective use of these promotions. The offers, discounts and promotions will not be cumulative. Promotions or offers may consist of special discounts or other types of benefits.

b) Points Club: Club members may earn Points that will be redeemable for the Benefits described herein. The Club is subject to the following special conditions in addition to the other conditions of the Club:

Welcome Points: once the member is duly registered, 10 (ten) Points will be awarded.

Only nights paid at a qualifying rate and booked through the website, reservation center or the front desk of any hotel (hereinafter "Qualifying Stays") will generate Points.

Points are not awarded for stays booked through third party websites (such as, but not limited to, Booking, Expedia and Despegar) or for reward nights, bonus nights, bookings made by tour operators or stays based on sponsorship rates or other special arrangements such as "Group Booking".  No other item invoiced by the Group will generate points. 

Club members must provide their membership number to generate points.

If a hotel ceases to be a Participating Hotel after a Club member makes a reservation, the stay will not qualify for earning Points.

For the sole purpose of calculating the points to be accumulated, the club will take the amount invoiced in Argentine pesos for the stay (not including taxes, fees, commissions, extra charges) and convert it to dollars at the selling exchange rate published by the Banco de la Nación Argentina on the business day prior to the date of invoicing. For such amount calculated in U.S. dollars and already paid, the club member will obtain 15% of such value in points.. For example, if a member purchases a night for 100 USD, that member will earn 15% as points which will equal 30 points.  Points are equivalent to 15 USD and can be used from the next reservation. Points will not be awarded for reservations paid with points. With partial payment, i.e. payment with points plus payment in currency, Points are awarded based on the portion of the purchase not paid with points.

Points will be deducted from the Club member's account at the time the redemption request is made.

All exchanges are final and cannot be returned for credit.

Discounts are not redeemable for cash or other benefits.

Validity of Points:
The validity of the points will begin to count from the date on which they are credited to the member's account. The expiration date of the points will be exactly 24 months after the accrual date.
Members will be notified of the expiration of their points through emails sent to the address registered in their account and/or through notifications on the program's mobile application or website. These notifications will be sent early enough to allow members to use their points before they expire.

3.2. Club Members may not enjoy the Benefits with respect to complimentary nights of stay, granted free of charge for any reason whatsoever.

3.3. Benefits can only be requested if the Club member has been identified as such at the time of booking. The granting of Benefits cannot be requested at any time if at the time of booking the member was not enrolled in the Club. The Benefits may be used, including special promotions, by only 1 (one) Club member per room, whose identity will be informed in the two cases mentioned above.

3.4. The Qualifying Stay will be considered even if the Club member is a no-show, provided that the requirements set forth in section 3.1 (b) and the Participating Hotel has complied with the charge for that night's stay.

3.5. The launch of promotions or special offers will be for a limited time, as indicated in the communication of each promotion or offer and may refer to all or some of the participating Hotels.

3.6. The benefits exchanged shall not be transferable and shall not be exchangeable for money or other goods. Once their redemption has been requested, members may not request their replacement or substitution for any other good, service or different benefit, even if, for whatever reason, they are unable to enjoy the same.

Use of personal data.

4.1. The Club and the data provided by Club members are applicable to the terms of the Privacy Policy of the Website. However, it should be noted that Grupo Tierra Gaucha respects the right of Club members to the protection of their personal data, which are protected by law. The database is the responsibility of Grupo Tierra Gaucha and is duly registered in accordance with applicable law. The participant who wishes to delete or know the data of his person that appear in it, update them or rectify errors, must request it by mail to club@grupotierragaucha.com.ar.

4.2. The data of Club members may be used for the purposes of the development of the Club in accordance with the provisions of these T&Cs and will be deleted from the database once the Club member is removed or the Club is deleted.

4.3. Any changes to the database will be effective within 96 hours of receipt of the request.

4.4. Grupo Tierra Gaucha may send promotions, offers and other communications to Club members on a regular basis, which may include offers and promotions for third party items. Club members who do not wish to receive such communications may request it to club@grupotierragaucha.com.ar.

4.5. The data of the Club members will not be disclosed to third parties, except to the managers, operators or owners of the Participating Hotels, insofar as this is necessary for the operation of the Club.

Completion of the Grupo Tierra Gaucha Rewards Club.

5.1. Grupo Tierra Gaucha reserves the right to cancel the Club in whole or in part without prior notice and to modify the Benefits, notifying such circumstances to the Club members.

5.2. In case of modification of the Club, all benefits will expire automatically, without any obligation or liability on behalf of the Tierra Gaucha Group or the Participating Hotels, and without implying any right for Club members to claim any compensation or reimbursement.

Jurisdiction and applicable law.

These T&C shall be governed, construed and enforced in all respects, including validity, interpretation and effect, in accordance with the laws of the Republic of Argentina. The courts of competent jurisdiction in the city of San Carlos de Bariloche and belonging to the third judicial district of the province of Río Negro shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these T&Cs or their subject matter or formation. If any term, provision, covenant or condition of the T&Cs is held invalid or unenforceable for any reason, the remaining provisions shall continue in full force and effect as if the T&Cs had been executed with the invalid portion deleted, provided that the T&Cs continue to express, without material change, the original intentions of the parties.
